There is no representation for the respondent. This writ petition is directed against the judgment dated 01.09.2017 passed by learned Additional District Judge, Khatima, Udham Singh Nagar in Misc. Civil Appeal No. 54 of 2016 under Order 43 Rule 1(r) CPC. By the impugned judgment, defendant was restrained from interfering with the peaceful possession of plaintiff, over the property in question.

As per office report, Civil Suit No. 69 of 2016 has been decided by learned trial Court on 29.09.2021.

Since the Misc. Civil Appeal No. 54 of 2016 was filed challenging the interlocutory order, passed by learned trial Court in Civil Suit No. 69 of 2016 and now the Suit itself has been decided, therefore, nothing survives in this writ petition.

Accordingly, writ petition is dismissed as infructuous.
