This writ petition was disposed of by this Court, by the judgment dated 24.02.2020, directing the learned Court of Civil Judge (Senior Division), Nainital, who was ceased with the Rent Control Case No. 2 of 2018, to decide the matter as per sub Rule (3) of Rule 15 of the Rules, framed under the Act No. 13 of 1972.
Today, the matter is listed on a Time Extension Application (MCC/1/2022), which has been filed by the learned Civil Judge (Senior Division), Nainital, on an administrative side, that the proceedings of Rent Control Case No. 2 of 2018, could not be proceeded with, within provided time on account of the restrictions imposed, due to COVID-19 and hence, he has sought an extension of time.
Though, this Court is not satisfied with the reasons given in the correspondence made by the office of learned Civil Judge (Senior Division), Nainital, but, however, taking a pragmatic view, this Application is being disposed of with the direction to the learned Civil Judge (Senior Division), Nainital, to decide the matter as expeditiously as possible, but not later than the time, as provided under sub Rule (3) of Rule 15 of the Rules framed under the Act No. 13 of 1972 from today.
Accordingly, the Time Extension Application (MCC/1/2022) would stand disposed of.
