Vide judgment and order dated 8.9.2014, passed by the CJM, Udham Singh Nagar, the revisionist has been convicted for the offences under Sections 420, 467, 468, 471 IPC. Maximum jail sentence awarded to the revisionist is to undergo R.I. for five years. In appeal, IInd Additional Sessions Judge, Rudrapur, Udham Singh Nagar, vide judgment and order dated 12.4.2022, affirmed the said judgment and order of the trial court.

Summon the LCR.

Learned Counsel for the revisionist would submit that the revisionist was on bail during trial as well as during pendency of appeal and he never misused the liberty. Learned Counsel for the revisionist further submits that there is great likelihood of the revisionist succeeding in the present revision.

Learned State Counsel would oppose the bail application and submit that there are concurrent findings of facts recorded by two courts below against the revisionist.

Having heard learned Counsel for the parties and considering the facts and circumstances of the case, and without any comment on the merits of the case, this Court is of the opinion that the applicant deserves bail. Hence, bail application (IA 1/2022) is allowed.

Let the applicant be released on bail on his furnishing a personal bond and executing two sureties, each in the like amount, to the satisfaction of Court concerned. It is made clear that prior to his release, the revisionist shall deposit the amount of fine as imposed by the trial court.
