                                JUDGMENT

Hon'ble Ravindra Maithani, J. (Oral)

Challenge in this petition is made to the

cognizance order dated 10.05.2016, passed in

Criminal Case No. 2309 of 2016, State vs. Yogesh

Singh and others, under Sections 324 and 506 IPC,

pending in the court of Additional Chief Judicial

Magistrate Haldwani, District Nainital (for short, "the

case") as well as the entire proceedings of the case on

the basis of amicable settlement between the parties.

2. Parties have also filed a joint compounding

application along with the affidavits of the petitioner

and the respondent no.2.

3. Heard learned counsel for the parties and

perused the record.

4. Learned counsel for the parties would

submit that they have amicably settled the dispute

and they are living in peace and harmony now.

5. The petitioner and the respondent no.2, as

identified by their respective counsel, are present

before the Court. They have accepted the compromise.

The respondent no.2 has submitted that he does not

want to proceed with the matter.

6. The parties have settled the dispute

amicably. Therefore, having considered the nature of

offence and all the attending factors, this Court is of

the view that it is a case which may be decided on the

basis of amicable settlement between the parties.

Accordingly, the petition deserves to be allowed.

7. Accordingly, the instant petition is allowed.

The cognizance order as well as the entire

proceedings of the case, is hereby quashed.

8. Compounding application stands disposed

of accordingly.
