Apprehending his arrest in connection with Case Crime No. 119 of 2017 U/s 323, 354, 504, and 506 I.P.C. lodged at P.S. Sidcul, District- Haridwar, the present anticipatory bail application has been filed by the applicant.
After arguing at some length on the anticipatory bail application, learned counsel submitted that the applicant was not arrested during investigation and the maximum sentence for the alleged offenses is not more than seven years and, therefore, learned counsel prayed that present anticipatory bail application be disposed of with the direction to the court below to decide the bail application of the applicant in light of the dictum of the Hon'ble Apex Court in Satender Kumar Antil v. CBI (SLP{Crl} No.5191 of 2021).
Learned State Counsel does not oppose the above prayer.
In these circumstances, the present anticipatory bail application is disposed of with the direction that in case the applicant puts his appearance and move an application seeking bail, the concerned Court will decide the same in light of the above judgment of the Hon'ble Apex Court.
Pending applications stand disposed of.
