The writ petitioner has filed this petition for quashing the FIR No.553 of 2021 registered u/s 384, 420, 406 IPC with P.S. Jhabrera, Distt.Haridwar.
It is argued by learned senior counsel that the informant submitted an information with the police station on 19.11.2021; all the allegations are levelled against co-accused Deepak Saini and Jitendra Saini; there is no allegation against the present petitioner regarding extortion; earlier, WPCRL No.2131 of 2021 was filed by co-accused Deepak in which the Co-ordinate Bench of this Court had granted protection to him in light of the judgment passed by the Hon'ble Apex Court in "Arnesh Kumar v. State of Bihar" reported in (2014) 8 SCC 273.
Learned State counsel as also learned counsel for the informant pray for and are allowed six weeks' time to file the counter affidavit.

Meanwhile, the I.O. will follow the guidelines formulated by the Hon'ble Apex Court in the case of Arnesh Kumar (Supra).
