CRLA No.47 of 2022
Hon'ble R.C. Khulbe, J.
Mr. Bhuwan Bhatt, learned counsel for the appellant.
Mr. Sachin Panwar, learned B.H. for the State.
Heard.
This criminal appeal is preferred against the judgment and order dated 04.01.2022 passed by Additional Sessions Judge, Roorkee, District Haridwar in Special Sessions Trial No.147 of 2019, "State Vs. Anil @ Tinku".
Admit.
Summon the LCR.
List thereafter.
Heard on the bail application (IA/2/2022) It is submitted by learned counsel for the appellant that the appellant was on bail during the trial; he did not misuse the conditions of bail as imposed on him by the trial Court; the trial Court has acquitted him u/s 506 IPC and u/s 7/8 of the POCSO Act; he is ready to furnish the sureties and he may be granted bail.
Per contra, the State counsel fairly admitted the above facts.
Looking to the facts and circumstances of the case, the appellant is enlarged on bail on his executing a personal bond and furnishing two sureties each in the like amount, to the satisfaction of the Court concerned, subject to deposition of the fine mount.
Bail application is allowed, accordingly. Urgency application (IA/1/2022) also stands disposed of.
(R.C. Khulbe, J.) Vacation Judge 28.01.2022 Sukhbant
