Hon'ble R.C. Khulbe, J.
Mr. D.C.S. Rawat, learned counsel for the revisionists.
Mr. V.S. Rathaur, learned A.G.A. for the State of Uttarakhand.
This criminal revision is preferred against the judgment and order dated 28.06.2017 passed by Judicial Magistrate, Pauri Garhwal in Criminal Case No. 853 of 2013, "State of Uttarakhand vs. Bhupesh and others " as well as the order dated 05.01.2022 passed by the learned District and Sessions Judge, Pauri Garhwal, District Pauri Garhwal in Criminal Appeal No. 29 of 2017, "Bhupesh & others vs. State of Uttarakhand".
Admit.
Summon the Lower Court's Record. Heard on Bail Application (IA No. 1 of 2022).
The revisionists were on bail during trial and during appeal and they did not misuse the condition as imposed by the trial Court.
Considering the nature of the case, it is a fit case for bail and the revisionists deserve bail at this Stage. Hence, bail application is allowed.
Let the revisionists be released on bail on the same terms and conditions on which they were granted bail during trial, subject to deposit of fine as imposed by the trial Court.
(R.C. Khulbe, J.) Vacation Judge 28.01.2022 SB
