This writ petition has been filed under Article 226 of the Constitution of India seeking a direction in the nature of mandamus directing the respondent no.1 and 2 to register the first information report against the private respondents in view of the judgment passed by the Hon'ble Apex Court in the light of Lalita Kumar case as well as in the light of judgment passed by this Hon'ble Court in Ashish Bhargawa under the relevant sections of I.P.C. in accordance with law.
It is submitted by learned counsel for the writ- petitioner that after the incident he moved an application before the concerned S.H.O. for registering the FIR; but the concerned S.H.O. did not lodged the FIR; thereafter, he moved an application before the concerned Senior Superintendent of Police but no order was passed on it.
Per contra, learned counsel for the State fairly submitted that a direction may be issued to the concerned Senior Superintendent of Police to decide the application within a period of 20 days.
In these circumstances, the instant writ-petition is disposed of with the direction that the Senior Superintendent of Police will decide the application of the writ-petitioner within a period of 20 days from today.
Pending applications, if any, also stand disposed of.
