And
State of Uttarakhand & others ....Respondents.
Counsel for the Petitioner : Mr. Sanpreet Singh Ajmani, learned counsel.
Counsel for the Respondent Nos.1 to 3 : Mr. R.K. Joshi, learned Brief Holder.
Counsel for the Respondent No.4 : Mr. Vikas Anand, learned counsel.
The Court made the following:
JUDGMENT:(per Hon'ble The Chief Justice Sri Vipin Sanghi)
The petitioner preferred the present writ petition to
seek directions to the State authorities to grant him adequate
police protection. The petitioner alleged that he had
apprehension of threat, coercion and harm coming to him
from respondent no.4.
2. On the basis of the averments made in the writ
petition, this Court passed an order dated 23.06.2022,
directing the Senior Superintendent of Police, Udham Singh
Nagar to give adequate police protection to the petitioner
until the next date of listing of the matter. The matter has not
been listed thereafter, and it is coming up before this Court
today.
3. Respondent no.4 has filed a detailed counter-
affidavit vehemently disputing the allegations made by the
petitioner against her.
4. Learned counsel submits that the petitioner has
falsely painted respondent no.4 black by making irresponsible
averments.
5. In these proceedings, we are not called upon to
determine the allegations made by the petitioner against
respondent no.4, and the response of respondent no.4
thereto.
6. Every citizen is entitled to be protected by the
State against any threat, coercion or harm from any other
person.
7. Learned counsel for respondent no.4, on
instructions, states that respondent no.4 has not issued any
threat, coercion or harm to the petitioner, and even in future,
no threat, coercion or harm shall be caused to the petitioner
by respondent no.4.
8. In the light of the aforesaid, we dispose of this
petition. Both, the petitioner and respondent no.4, are
directed to maintain peace, law and order and not to take the
law into their own hands.
9. Pending application, if any, also stands disposed of.
