                      JUDGMENT

1. This application (MCC No. 1 of 2021) has been filed by the petitioner seeking recall of the order dated 09.04.2021, whereby the contempt petition was dismissed based on the statement made by learned counsel for the State that gratuity along with interest payable to the petitioner has been sanctioned by the concerned Divisional Forest Officer.

2. In this recall application, it is stated that the amount of gratuity and interest has not been released to the petitioner.

3. Learned Standing Counsel for the opposite parties was asked to get instructions in the matter. Today, on instruction, Mr. J.S. Bisht, learned Standing Counsel for the opposite parties submits that gratuity amounting to ₹3,68,990/- has been paid to the petitioner out of which ₹55,908/- was paid to

him earlier and remaining amount of ₹3,13,082/- has been credited to the saving bank account of the petitioner on 27.07.2021. He further submits that regarding interest, payable to the petitioner on the gratuity amount, matter has been referred to the State Government for sanction, and interest amount would be paid to the petitioner upon receipt of necessary sanction from the State Government.

4. In view of the statement made by Mr. J.S. Bisht, learned counsel for the opposite parties, the recall application is dismissed. In case, component of interest is not paid to the petitioner within four months, petitioner shall be at liberty to approach this Court again.
