26.07.2021 RERA Appeal No. 5 of 2021
Hon'ble Sharad Kumar Sharma, J.
(Via Video Conferencing) Ms. Shaifali Singh, Advocate, holding brief of Mr. Himanshu Pal, Advocate, for the appellant.
The appellant has preferred this RERA Appeal, invoking the provisions contained under Section 58 to be read with Section 100 of the CPC, wherein the appellant has put a challenge to the impugned judgment passed by the Uttarakhand Real Estate Appellate Authority in Appeal No. 10 of 2019 on 11.10.2019.
The Appeal is supported with a Delay Condonation Application (IA/1/2021), explaining the delay, which has chanced in filing the Appeal on the ground of the judgment rendered by the Hon'ble Apex Court, where suo moto cognizance was taken in relation to those proceedings, where the limitation was to be liberally construed where the limitation was expiring during the lockdown period. But, since there is an independent application for condonation of delay, preferred by the appellant, let notices be issued to the respondent.
The appellant would take steps within a period of one week from today.
List this RERA Appeal for orders on the Delay Condonation Application after the notice is served.
