Urgency Application (IA) No.1545 of 2021 Stay Extension Application (IA) No.11546 of 2021 In C-482 No.1537 of 2019 Hon'ble Sharad Kumar Sharma, J.
Mr. Pawan Mishra, learned counsel for the applicant.
Mr. V.S, Rathore, learned Assistant Government Advocate assisted by Mrs. Mamta Joshi, learned Brief Holder for the State of Uttarakhand/respondent No.1.
While admitting this C-482 application, the Coordinate Bench of this Court, by an order of 16.08.2019, had already granted an interim stay in favour of the applicant, by virtue of which the proceedings pending before the court below were directed to be kept in abeyance and notices were issued. In compliance thereto, the applicant has already taken steps for serving the respondents and as per the office report dated 22.01.2021, the service has been effected on respondents recently as it reflected from the order dated 02.09.2019 also.
Today, the matter listed on urgency application, as well as, the stay application preferred by the applicant because the court below is treating that the interim order granted would expire within six months in view of the judgments of the Hon'ble Apex Court. Hence, on that pretext the extension application has been filed.
Considering the circumstances to the effect that the private respondents, to whom the notices have been issued by this Court though have been served and they are yet to put appearance. The interim order as already granted by this Court on 16.08.2019, would be treated to be continued and extended till next date of listing.
