                                                WPSS No. 119 of 2018
                                                Hon'ble Sharad Kumar Sharma, J.

Mr. Dinesh Chauhan, Advocate, for the petitioner.

Mrs. Monika Pant, Advocate, for the Union of India.

The learned counsel for the petitioner contends, that the services of the petitioner as 'Gamin Dak Sewak', are governed by the provisions of 'Department of Posts, Gramin Dak Sewaks (Conduct and Employment Rules 2001).

By virtue of the impugned orders, which are under challenge in this writ petition, the services of the petitioner was dispensed with by the order dated 16.05.2016, and later on, it was affirmed by the Appellate Authority, by an order dated 30.11.2017.

The learned counsel for the petitioner had submitted that being aggrieved against the aforesaid two orders, the petitioner has preferred a Revision, as it has been contemplated under Rule 19 of the Rules 2001 and the same is yet pending consideration and has not yet been decided on its merits.

On this short premise, without venturing into the merits of the matter, including the issue of maintainability of the writ petition because the postal department has been notified before the Central Administrative Tribunal, this writ petition, at this stage, is being disposed of with request to the Revisional Authority i.e. Chief Post Master General, Uttarakhand Region, Dehradun, to decide the Revision which has been filed by the petitioner herein on 16.12.2017, as expeditiously as possible but not later than three months from the date of production of the certified copy of this judgment.

Subject to above observation, the writ petition stands disposed of.

(Sharad Kumar Sharma, J.) 02.12.2021 Mahinder/
