The plaintiff/petitioners had preferred this Writ Petition, as against the judgment of 26th October, 2010, rendered in Misc. Civil Appeal No. 41 of 2010, Gurdev Singh Vs. Paramjeet Singh and others, which was preferred by the defendant as against the allowing of the application under Order 39 Rule 1 and 2 of the CPC, in Suit No. 46 of 2010, Paramjeet Singh and another Vs. Gurdev Singh, which was then instituted before the Court of Civil Judge (Junior Division), Ramnagar, District Nainital.
When the Writ Petition was entertained, an interim order was granted by the Coordinate Bench of this Court on 7th December, 2010, directing the parties to maintain the status quo, and ever since 22nd June, 2012, the Writ Petition was never listed thereafter.
Today when the matter was listed, this Court directed the Registry to collect the information from the Subordinate Court with regard to the status of the Suit, and it has been informed that the aforesaid Suit has already been decided on 21st September, 2013.
In that eventuality, the very purpose of continuance of the Writ Petition has been rendered infructuous.
Accordingly, the Writ Petition is dismissed as having rendered infructuous.
