This application has been filed for condoning the delay of 99

days in filing the appeal.

It is stated in the said application by the applicants that the

judgment of the Learned Single Judge was pronounced on 20.06.2025 in

WP(C)No.89 of 2024. Thereafter, the matter was scrutinized by the Head

Office of Staff Selection Commission (2nd respondent) and only on

10.09.2025, decision was taken to file appeal and after further process, the

appeal came to be filed after delay of 99 days.

Though, the private-respondent has opposed the condonation of

delay by contending that proper reasons are not assigned for condoning the

same and that there was negligence and lack of diligence apart from absence

of bonafides on the part of the applicants, since the judgment which is to be

challenged requires to be studied and appropriate decision has to be taken by

the competent authority and steps should be taken to file the appeal,

sometimes delay occurs in filing the appeal. The said delay in the instant

case is not inordinate.

We find sufficient cause for condoning the said period of delay

in the facts and circumstances of the case.

Therefore, I.A.01 of 2025 is allowed and the delay in filing the

appeal is allowed.
