Heard Ld. Counsel, Ms. S.Deb(Gupta) for the petitioner.

Ld. Counsel, Ms. Deb (Gupta) submits that after the petitioner has gone on retirement from the post of M.P.S(F)[Group-C], the department has detected some over-drawn of pay by her and therefore, the office of Accountant General vide their letter dated 06.03.2025 has suggested for recovery of pay and allowances. Ld. Counsel of the petitioner submits that if such recovery is done at this stage, the very purpose of the writ petition may be frustrated or at least some complication will arise.

Ld. Addl. GA, Mr. D. Sarma accepts notice for respondent nos. 1 to 4 and Ld. Counsel, Ms. R. Bhattacharjee accepts notice for respondent nos.5 & 6.

Both the Ld. Counsel of the respondents have sought for an adjournment to submit Counter Affidavit.

Considered.

4 weeks' time is allowed to submit Counter Affidavit.

Meanwhile, no step will be taken by the respondents for recovery of any amount from the petitioner.
