Learned Counsel, Mr. J. Majumder is present on behalf of the

appellant.

Learned Counsel, Mr. A. K. Deb is present on behalf of the

respondent-Insurance Company.

At this stage, Learned Counsel for the Insurance Company

submitted that the Insurance Company has filed one CO(FA) No.7

of 2024 against the same judgment with an I.A. which was

dismissed for default and for restoration of the said petition, one

I.A. is filed by the Insurance Company before the Court today and

the same is not listed before the Court at the time of hearing.

Registry be asked to list this appeal along with the I.A.

[restoration petition], if filed, arising out of CO(FA) No.7 of 2024

on the next date.

In the mean time, Learned Counsel for the Insurance

Company may collect the paper book.

List this matter for hearing on 31.01.2025.
