IA No.1 of 2024
In CRL.REV. P. No.25 of 2024
Sri Bapi Acharjee
----Applicant(s)
Versus
Smt. Supriya Acharjee
----Respondent(s)
For Applicant(s) : Mr. N. Majumder, Adv.
For Respondent(s) : None
HON'BLE MR. JUSTICE BISWAJIT PALIT
Order 30/05/2024 Heard Learned counsel Mr. N. Majumder for the applicant-
petitioner.
The applicant-petitioner has preferred this revision petition
challenging the ex-parte judgment dated 24.06.2022 passed by
Learned Judge, Family Court, Belonia, South Tripura in Case No.
Maint. 21 of 2021 under Section 125 of Cr.P.C. Along with that
petition the applicant has filed another application for condoning the
delay of 575 (five seventy five) days and also has separate petition
for staying the operation of the impugned judgment. Earlier inspite
of issuing notice the same could not be served upon the OP-
respondent and inspite of paper publication also the OP-respondent
did not appear before this court today.
Since the OP respondents has not appeared it is presumed that
she has got no objection in this matter.
So considering all the court is satisfied with the grounds as
mentioned in the petition the delay is condoned accordingly.
In view of the above, this interlocutory application thus stands
disposed of.
