By the impugned judgment dated 05.08.2023, the Principal

Secretary, Revenue Department has held that the allottee or his legal heirs

have no possession over 0.62 acre of land in RS Plot

No.1468/P,1471/P,1477/P,1483 and 910 of mouja Dhaliarkandi. Hence, the

allottees or their legal heirs have violated condition No.4 of the allotment

order under which the allotted land was to be cultivated within 5(five) years

from the date of allotment i.e. 1984. The District Magistrate & Collector,

Unakoti District has been directed to arrange for incorporating 0.62 acre of

land in the khas Khatian of mouja Dhaliarkandi while deleting the said area

from the allottee Khatian No.544 of same mouja.

Learned counsel for the petitioners submits that the aforesaid

findings suffer from errors.

Issue notice on the respondent under ordinary process and

speed post for which requisites be filed within one week. Additionally, let

the District Magistrate & Collector, Unakoti District be also impleaded as

respondent in the instant petition by learned counsel for the petitioners.

Copies of the petition along with its enclosures be served on

learned counsel for the State by 27.09.2023 and receipt be filed in the

Registry so that the name of learned counsel for the State can appear in the

cause list.

Accordingly, let the matter be listed on 24.11.2023.
