Writ petition was preferred by the petitioners who are serving
on the post of Driver as Group-D employee under the Forest Department,
Government of Tripura with the prayer that the respondents may be asked
to show-cause as to why their names have not been forwarded to the
Transport Department for consideration for promotion to the post of
Driver. Petitioners have also prayed that the respondents may be asked to
show as to why they have not been promoted to the post of Driver.
2. Petitioners had relied upon a judgment dated 17.01.2022
passed in WP(C) No.592 of 2021 and other connected matters at
Annexure-3 in order to submit that this Court had directed the concerned
department to take speedy steps to complete the process of organizing
tests for making recommendation for promotion to the post of Driver in
Group-C, but since the names of the petitioners were not amongst one of
the petitioners therein, therefore, their matter was not sent.
3. However, respondents in their Counter Affidavit at
paragraph-10 have made categorical statement that the Forest Department
has already sent the names of the petitioners to the Additional DM &
Collector, West Tripura, Agartala for assessment of their eligibility for
promotion to the post of Driver (Group-C) on 05.03.2022 as per the
Tripura Government Vehicles Drivers Service Rules, 1979.
4. Having regard to the categorical statement made by the
respondents as above, Mr. C.S. Sinha, learned counsel for the petitioners,
submits that by and large the grievances of the petitioners raised in the
writ petition have been redressed.
5. Writ petition is accordingly disposed of.
Pending application(s), if any, also stands disposed of.
