Order

This present application has been filed under Section 389

of the Code of Criminal Procedure for suspending the judgment

dated 16.01.2023 passed by the learned Addl. Sessions Judge,

Gomati Judicial District, Udaipur in case No.S.T.35(T-1) of 2017

convicting the appellant under Sections 302 of the Indian Penal Code

and sentencing him by order dated 19.01.2023 to suffer R.I. for life

and also to pay a fine of Rs.10,000/- with default stipulation.

After perusal of the material evidence on record being

aided by the learned P.P., this Court is of the opinion that the benefit

of suspension cannot be granted to the applicant herein as prayed

for.

Accordingly, the prayer for suspension against the

applicant is rejected.
