Heard Mr. R.G. Chakraborty, learned counsel for the

appellant as well as Mr. Karnajit De, learned Additional Government

Advocate appearing for the respondents.

2. It is agreed by learned counsel for both sides that the

present appeal is covered by a judgment dated 01.12.2020 passed by this

Court in L.A. App. No.83 of 2018 and another connected matter titled as

Smt. Milan Biswas Nandi and another vs. The Land Acquisition

Collector and others referred to the Judgment & Order dated 11th

January, 2023 passed in L.A. App. No.10 of 2022 and L.A. App. No.11

of 2022 titled as Sri Nimai Datta vs. The L.A. Collector and others and

Smt. Gita Rani Baidya vs. The L.A. Collector and others respectively

wherein this Court determined the market value of the land @

Rs.5,00,000/- per kani along with all other statutory benefits, as

provided under the L.A. Act, 1894 instead of Rs.1,50,000/- per kani as

decided by the learned L.A. Judge.

3. Accordingly, the instant appeal stands disposed of in terms

of the directions contained therein applicable mutatis mutandis to the

present case also. The claimant is entitled to get compensation at such

rates and on such terms as stands determined by this Court in the said

decision. Needless to add, the amount of compensation if not already

released be positively released in favour of the claimant unconditionally.

4. Registry shall place copy of both the Judgment & Order

dated 11.01.2023 passed in L.A. App. No.10 of 2022 and Judgment

dated 01.12.2020 passed in L.A. App. No.83 of 2018 on record.

5. Stay order, if any, stands vacated. Pending application(s), if

any, also stands disposed of.
