Judgement Date : 6 September, 2022
HIGH COURT OF TRIPURA
AGARTALA
WP(C) 773 OF 2022
Smt. Gayatri Chakraborty & Anr. Vrs. The State of Tripura & Ors.
Present:
For the petitioner (s) : Mr. K. Nath, Advocate.
For the respondent (s) : Mr. A. Bhowmik, Advocate.
Mr. D. Sharma, Addl. G.A.
HON'BLE MR.JUSTICE ARINDAM LODH 06.09.2022 Order Heard Mr. K. Nath, learned counsel appearing for the petitioners. Also heard Mr. A. Bhowmik, learned counsel appearing for the Respondent-Agartala Municipal Corporation and Mr. D. Sharma, learned Addl. G.A. appearing for the State-respondents.
The petitioners of this writ petition have claimed their gratuity. The petitioner no.1 has retired from service in the year 2010 and the petitioner no.2 has retired from service in the year 2014. It is seen that after a lapse of long years they approached this court claiming the above relief.
In my opinion, the claim is absolutely barred by doctrine of delay and laches. This court has noticed its earlier judgment and duly considered. I re-iterate that the instant case is absolutely barred by delay and laches. Hence, the instant petition stands dismissed.
