Heard Mr. S. Lodh, learned counsel appearing for the appellant. This is an application under Section 378(4) of the of Cr.P.C. for seeking Special Leave petition against the judgment and order dated 19.09.2022 passed by the Judicial Magistrate, First Class, Belonia, South Tripura in N.I.15 of 2019 whereby the Judicial Magistrate, First Class, Belonia, South Tripura acquitted the respondent OP No.1 for committing offence punishable under Section 138 of N.I. Act, 1881.
Issue notice calling upon the respondents to show cause as to why the leave as sought for preferring an appeal against the judgment and order dated 19.09.2022 passed by the Judicial Magistrate, First Class, Belonia, South Tripura in N.I.15 of 2019 whereby the Judicial Magistrate, First Class, Belonia, South Tripura such further order(s) shall not be allowed as to this Court may deem fit and proper having regard to the circumstances of the case.
Notice is made returnable on 02.12.2022.
Since Mr. R. Datta, learned P.P. appears and waives notice for the respondent No.2, no formal notice is called for.
However, the appellant is permitted to take out notice on the respondent No.1 by way of RPAD and file proof of service before the next returnable date.
