Order

Heard Mr. S. Bhattacharjee, learned counsel appearing

for the petitioner as well as Mr. D. Sharma, learned Addl.

G.A. appearing for the State respondent.

It is the case of the petitioner that some part of his

pension has been paid and she is aggrieved that the said

calculation is not in terms of the Apex Court judgment dated

14.07.2016 passed in I. A No.244 of 2009 in WP(C)

No.1022 of 1989 between the All India Judges ' Association

& ors vs. Union of India & ors., in favour of the petitioner.

In view of the same without expressing any opinion on

merits, this instant writ petition is disposed of giving liberty

to the petitioner herein to file a fresh representation before

the concerned authority giving the calculation on the

strength of the order passed by the Apex Court. On receipt

of such representation, the concerned authority within a

period of 2(two) months from the date of receipt of the

same shall dispose of the representation by giving an

opportunity of personal hearing to the petitioner.

The petitioner along with the representation shall file

his calculation statement with regard to the amount already

received and the balance amount that is to be paid in terms

of the Apex Court Judgment as stated above. Further, the

petitioner is also at liberty to calculate the amount of

interest in the event it is found that he is entitled to the

same.

Hence, this writ petition is disposed of and

consequently, miscellaneous applications pending, if any,

shall stand closed.
