HON'BLE MR. JUSTICE ARINDAM LODH Order 28/02/2022 Heard Mr. Raju Datta, learned counsel appearing on behalf of the petitioner.

This is a contempt petition filed by the petitioner under Section 12 of the Contempt of Courts Act, 1971 for drawing up of proceeding against the respondents for willful disobedience of the judgment and order dated 30.04.2021 passed by this court in WP(C) 747 of 2020. The relevant portion of the order is reproduced here-under:-

"The rights of the petitioners to be treated as regular employee with the prescribed scale of pay under the respondents shall be considered after completion of further 10 years of service as Daily Rated Workers. Accordingly, it is directed that the Agartala Municipal Corporation shall treat the petitioners as Daily Rated Workers henceforth and consider the regularization of the petitioners in the regular scale of pay after completion of 10 years of service as Daily Rated Workers."

In view of the submission of learned counsel that the aforesaid order has not been complied with till today, this court is inclined to issue notice upon the Contemnors.

Issue Notice calling upon the Contemnors to show cause as to why a proceeding under Section 12 of the Contempt of Courts Act shall not be drawn against them, as prayed for; and/or why such further and other order(s) shall not be passed as to this Court may deem fit and proper. Notice is made returnable on 11.04.2022. The petitioner shall take steps for service of notice upon the Contemnors within 7 (seven) days by registered post with AD.
