Heard Mrs. S. Deb(Gupta), learned counsel appearing
for the petitioner as well as Mr. D. Sharma, learned Addl.
G.A. appearing for the State-respondents.
By way of filing the present review petition, the
petitioner has prayed for correction of the judgment of this
Court passed in WP(C) No.604 of 2019 dated 20.11.2019
holding that at the time of appointment of the petitioner,
the pay scale of the petitioner as skilled worker was
prescribed as Rs.370-650/- under ROP Rules, 1982.
Mrs. Deb (Gupta), learned counsel appearing for the
petitioner has submitted that this finding of this Court
should be rectified on the basis of some judgments passed
by Labour Court which are confirmed by Division Bench of
this Court. The Labour Court held that skilled workers and
industrial workers are equivalent posts and for that matter,
there should be pay parity, and further held that the pay
scale of industrial workers at Rs.430-850/- should be
applied to the skilled workers also.
On the basis of this finding of the Labour Court, Mrs.
Deb(Gupta), learned counsel has urged this Court to review
its judgment passed in WP(C) No.604 of 2019 filed by the
petitioner.
I have heard Mr. D. Sharma, learned Addl. G.A.
appearing for the State-respondents. I have given my
thoughtful consideration to the submissions advanced by
the learned counsels appearing for the parties.
While deciding the case filed by the petitioner under
WP(C) No.604 of 2019, it was not the subject matter as to
whether the skilled workers and the industrial workers were
equivalent posts or not. As such, this Court held that the
pay scale given to the petitioner at the time of the initial
appointment as a skilled worker should be applicable to the
petitioner which was also reflected in his appointment letter.
The petitioner has prayed for granting a corresponding
revised pay scale under subsequent ROP Rules. Needless to
say, the petitioner will definitely entitle to get corresponding
revised pay scales of Rs.370-650/- prescribed under
subsequent ROP Rules.
With the above observations, the instant review
petition stands dismissed.
