Heard Mr. R. Dasgupta, learned counsel appearing for the
petitioners.
This is a petition under Article 227 of the Constitution of India
challenging the legality and propriety of the judgment dated 03.05.2019
delivered in Civil Misc.(PMP)21 of 2014. The substantive ground that has
been taken is that there is no evidence but without evidence the Additional
District Judge, Court No.4, West Tripura, Agartala has assessed the land
value. As such, the finding on the assessment requires to be interfered
with.
Having that ground into consideration, this petition is admitted
to be heard on merit.
Issue notice calling upon the respondents to show cause as to
the rule should not be issued as prayed for; and/or any other such further
order(s) shall not be passed as to this Court may deem fit and proper
having regard to the circumstances of the case.
Notice is made returnable on 05.03.2021.
Steps for service on the respondents be taken by the
petitioners within a week from today by registered post with AD.
