ORDER:
This Writ Petition is filed seeking the following relief:-
"...pleased to issue a direction, order or Writ more particularly one in the nature of Writ of Mandamus declaring the action of the respondents particularly the 4rd respondent in interfering with personal life and liberty of the petitioner by threatening and insisting to make settlement of business score/civil dispute with respondent No.5 as is illegal, arbitrary and without jurisdiction and violative of Article 21 of Constitution of India and against the Principles of Natural Justice and pass..."
2. Heard Sri K.Sridhar Rao, learned counsel for the petitioner
and Sri M.Srinivas, learned Assistant Government Pleader for
Home appearing for the official respondents and with their
consent, this writ petition is being taken up for disposal at the
admission stage.
3. Learned counsel appearing for the petitioner would submit
that there are admitted private disputes between the petitioner and
unofficial respondent No.5. At the instance of unofficial
respondent No.5, respondent No.4 is interfering with the
petitioner's personal life and liberty and is exerting undue pressure
on the petitioner to settle the disputes with unofficial respondent
No.5. Because of the continued harassment, the petitioner is
unable to attend to his duties; hence, the present writ petition has
been filed.
4. Learned Assistant Government Pleader for Home by
furnishing the written instructions passed on to the learned
Government Pleader for Home by the Sub-Inspector of Police,
Keesara Police Station, Malkajgiri Commissionerate, dated
15.04.2026 would submit that on the complaint filed by
respondent No.5, respondent No.4 registered FIR.No.205 of 2024,
dated 23.03.2024 for the offences punishable under Section 406
and 420 IPC against the petitioner and his wife. During the course
of investigation, the Sub-Inspector of Police, Keesara Police Station,
examined the complainant, recorded his statement and collected
relevant evidence.
5. It is further submitted that for the purpose of investigation
and for issuance of notices under Section 35(3) of BNSS, the
investigating officer called the petitioner and his wife to appear
before him. However, instead of cooperating with the investigation,
the petitioner has filed this writ petition only with an intention to
exert pressure on the investigating officer and to stall the
investigation and lawful proceedings. The allegation that the
investigating officer threatened or exerted pressure upon the
petitioner to settle the private disputes with unofficial respondent
No.5 is false and baseless. Hence, seeks to dismiss the writ
petition.
6. In the light of the aforesaid facts and circumstances of the
case and upon perusing the material available on record and also
the written instructions furnished by the learned Assistant
Government Pleader for Home, this writ petitions is disposed of,
directing the respondent-authorities not to not interfere with the
petitioners' personal life or liberty and also directing the
respondents to conduct investigation strictly in accordance with
law. There shall be no order as to costs
As a sequel, the miscellaneous petitions pending, if any,
shall stand closed. No costs.
