ORDER:
Heard Smt. P. Sumalatha, learned counsel for the petitioner. In spite
of service of notice on respondent on 09.09.2025, none appeared and there
is no representation for the respondent. Perused the entire record.
2. This petition is filed by the petitioner seeking transfer of
H.M.O.P.No.94 of 2024 pending on the file of the II Additional Senior
Civil Judge-cum-II Additional Assistant Sessions Judge, Hanamkonda, to
the Court of Senior Civil Judge, Peddapally District.
3. Since there are catena of judgments of the Hon'ble Supreme Court to
consider the convenience of wife while transferring matters arising out of
matrimonial disputes, keeping in view of the convenience of the petitioner
herein, the relief prayed for is granted.
4. In the result, the Transfer Civil Miscellaneous Petition is allowed
and the H.M.O.P.No.94 of 2024 pending on the file of the II Additional
Senior Civil Judge-cum-II Additional Assistant Sessions Judge,
Hanamkonda, is withdrawn and transferred to the Court of Senior Civil
Judge, Peddapally District. The entire original record shall be transmitted RY,J Tr.CMP_124_2025
within a period of one month. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this appeal, shall stand closed.
