            CRIMINAL PETITION NO.9474 OF 2021

JUDGMENT:

Petitioner is arrayed as A-4, along with A-1 to A-3, in the

charge sheet filed by the Women Police Station, Begumpet Police.

The said charge sheet was filed on the basis of the complaint of

2nd respondent. According to the case of 2nd respondent, her

marriage with A-1 was performed on 27.10.2015 as per Christian

rites and the petitioner herein is a match maker who was

appointed for the marriage. Further, petitioner had illegal

intimacy with A-1 and at the instance of this petitioner, A-1 was

harassing 2nd respondent. On 13.12.2015, 2nd respondent went to

Hyderabad and joined A-1, thereafter on 01.01.2016, the petitioner

called 2nd respondent and confined her in a room. Then 2nd

respondent noticed that there were lipstick marks and perfume

smell on the shirt of A-1. A-1 vacated the house without

intimating 2nd respondent in the year 2016. A meeting was held

due to differences between 2nd respondent and A-1.

The petitioner/A-4 interfered and instigated A-1 to end the

relationship with the 2nd respondent. Thereafter, this petitioner

and A-1 started living together under one roof.

2. According to the charge sheet filed, this petitioner was

having relationship with A-1 and she is a concubine of A-1.

Therefore, she is responsible for the harassment.

3. The offences alleged in the charge sheet are under Sections

498-A, 506, 420 read with 34 of IPC against A-1 and against this

petitioner/A-4, who was found to be a concubine of A-1. She has

committed offence under Sections 420, 506 read with 34 of IPC.

4. To attract an offence of cheating there must be a deliberate

misrepresentation pursuant to which the person must have been

induced. The persons who have been induced must have

delivered the property believing the said misrepresentation.

Even according to the case of the prosecution, 2nd respondent

married A-1. Though the petitioner had mediated in the

marriage and fixed the marriage between the A-1 and

2nd respondent, the same does not amount to cheating. There is

no allegation of any criminal intimidation as such the offence

under Section 506 IPC is not attracted.

5. Accordingly, proceedings against this petitioner/A-4 are

quashed.

6. Accordingly, the criminal petition is allowed.

Miscellaneous applications pending, if any, in this criminal

petition, shall stand closed.
