CRIMINAL PETITION No.13156 of 2024
ORDER:
The petitioners/A1 and A2 filed the criminal petition
aggrieved by the order of the learned Special Judge for SPE &
ACB Cases-cum-III Addl.district and Sessions Judge, Warangal,
in Crl.MP.No.04 of 2024 in Cr.No.11/RCT-ACB-WRL/2023,
directing the petitioners to appear before Director, Telangana
State Forensic Laboratory, Hyderabad, on 02.09.2024, to give
voice samples for the purpose of comparison with the audio and
video evidence collected during investigation.
2. Learned Counsel for the petitioner argued that the
direction given by the learned Special Judge is in violation of
the Article-20, clause-3 of the Constitution; and that the
question of forcing the petitioners to speak against themselves
does not arise.
3. The Honourable Supreme Court in Ritesh Sinha v. State
of UP and another 1 held that the Judicial Magistrate has
power to order a person to give his voice sample for the purpose
of investigation of crime.

4. In view of the aforesaid Judgment of Honourable Supreme
Court, there are no grounds in the criminal petition.
5. Accordingly, Criminal Petition is dismissed.
