                WRIT PETITION No.6807 of 2025

ORDER:

It is stated that the petitioner is the owner and possessor

of the land admeasuring Ac.0.04 guntas in Sy.No.128/B/2,

situated at Thorrur Village Shivar, Thorrur Mandal,

Mahabubabad District, having purchased the same through

registered sale deed bearing document No.1821 of 1984, dated

26.06.1984. It is further stated that the name of the petitioner

was also recorded in pahanies as pattadar vide Khata No.1064

but no passbook has been issued to him. It is further stated

that when some of the third parties are disputing his right and

title over the subject property, he was constrained to institute a

suit for perpetual injunction vide O.S.No.257 of 2008 on the file

of the Junior Civil Judge, Thorrur and the said suit was decreed

vide Judgment and decree, dated 28.12.2016. It is further

stated that after disposal of the said suit, when the revenue

records were not updated, the petitioner was constrained to

make a representation seeking to mutate his name in the

revenue records and consequential issuance of pattadar pass

book and when the said representation was not considered, he

was constrained to institute W.P.No.32600 of 2022 before this

Court and this Court vide order, dated 17.08.2022, directed the

respondents therein to consider the application No.

LM2200031519 submitted by the petitioner in Dharani Portal

after issuing notice to all the interested persons and pass

appropriate orders within a period of eight (08) weeks from the

date of receipt of a copy of the said order. It is further stated

that after issuance of the said directions, respondent No.2 vide

proceedings No.E5/139/2022, dated 11.12.2023, directed

respondent No.4-Tahsildar to rectify the revenue records in

respect of the land to an extent of Ac.0.04 guntas in

Sy.No.128/B/2 in favour of the petitioner. The grievance of the

petitioner is that even after lapse of more than a year,

respondent No.4 has not implemented the proceedings issued

by respondent No.2 and thereby the petitioner is not in a

position to receive various incentives sanctioned by the

Government as investment subsidies for cultivation of his land.

2. Considered the submissions of the learned counsel for the

petitioner and Sri L.Ravinder, learned Assistant Government

Pleader for Revenue appearing for respondent Nos.1 to 4 and

with their consent, this writ petition is being disposed of at the

admission stage.

3. Sri L.Ravinder, learned Assistant Government Pleader for

Revenue has not disputed the proceedings issued by the District

Collector directing the Tahsildar to rectify the entries in respect

of the subject land.

4. It is very unfortunate that even after the directions issued

by this Court in W.P.No.32600 of 2022 and the directions

issued by respondent No.2 after conducting enquiry, respondent

No.4 is not adhering to the directions issued by this Court as

well as his superior authority. On the face of record, the

indifferent attitude of respondent No.4 in implementation of the

Court orders and the directions issued by his superior officers is

deprecated. The Assistant Government Pleader represented that

the delay was only because of the frequent transfers and

technical defects in Dharani Portal, instead of directing

respondent No.2 to initiate disciplinary action against

respondent No.4, this Court is of the opinion that the ends of

justice would be met if respondent No.4 is directed to pay costs

of Rs.50,000/- payable to the Account No.62423627327

(Library) of the Telangana High Court Advocates' Association,

Hyderabad within a period of two weeks from the date of receipt

of a copy of this order and proof of payment thereof shall be

filed before the Registry. Further, respondent No.4 is directed

to carry out necessary corrections in the revenue records as

directed by respondent No.2 in proceedings No.E5/139/2022,

dated 11.12.2023, within a period of two (02) weeks from the

date of receipt of a copy of this order.

5. Accordingly, this Writ Petition is allowed.

6. As a sequel, the miscellaneous petitions pending, if any,

shall stand closed.
