JUDGMENT (Per the Hon'ble the Acting Chief Justice Sujoy Paul):

Sri M.V.Pratap Kumar, learned counsel represents

Sri Naren Sai Chiramdasu, learned counsel for the appellant and

Sri M. Krishna Chaitanya, learned counsel for respondent

No.1/writ petitioner.

2. With the consent, finally heard.

3. This Writ Appeal takes exception to the order dated

31.01.2025 in W.P.No.2788 of 2025 passed by the learned Single

Judge.

4. The present appellant is respondent No.4 before the writ

Court. The singular ground raised during the hearing is that the

impugned order is passed by the learned Single Judge without

putting the present appellant/respondent No.4 to notice. The

impugned order may have adverse impact on the present

appellant and in this view of the matter, the present appellant

should have been put to notice and should have been heard

before passing the impugned order.

5. Learned counsel for respondent No.1/writ petitioner

fairly admitted that the impugned order is, indeed, passed

without putting the present appellant to notice.

6. Considering the aforesaid, the impugned order dated

31.01.2025 passed by the learned Single Judge is set aside.

W.P.No.2788 of 2025 is restored to its original number. The

Registry shall list the Writ Petition on 24.03.2025 before the

learned Single Judge. The present appellant shall appear on the

said date before the learned Single Judge and for this purpose,

no separate notice will be required to be issued.

7. Accordingly, this Writ Appeal is disposed of without

expressing any opinion on the merits of the case. No costs.

Interlocutory applications, if any pending, shall also

stand closed.
