O R D E R:
1. This Civil Revision Petition is filed aggrieved by the
docket order dated 19.09.2024 in E.P.No.29 of 2022 in
A.R.B.No.241 of 2020, on the file of Principal Junior Civil
Judge-Cum-Judicial Magistrate of First Class at Bhongir.
2. Heard learned counsel for the revision petitioner/decree
holder and the learned counsel for the
respondents/judgment debtors.
3. The petitioner is a decree holder who filed an Execution
Petition before the Court below praying attachment of certain
movable articles. Movable articles are mentioned at Sl.Nos.1
to 12 in the description of the property. However, there is a
note which reads "Any other articles found at the time of
attachment, if the above mentioned articles are not found."
4. When the petitioner is not aware of the existence of
such movable articles, there is no infirmity in the order of the
trial Court in dismissing the EP. However, this will not
preclude the petitioner moving the Court after identifying
movable articles for seeking similar relief.
5. Accordingly, the Civil Revision Petition is disposed off at
the admission stage. Miscellaneous Petitions, pending if any,
shall stand closed.
