CRIMINAL REVISION CASE No.2303 OF 2010
O R D E R:
This Criminal Revision Case is filed under Sections 397 and
401 of the Code of Criminal Procedure (for short 'Cr.P.C.) by
revision petitioner aggrieved by the Judgment dated 08.12.2010
passed in CRL.A.No.190 of 2010 by the learned II Additional
Metropolitan Sessions Judge at Hyderabad wherein the Judgment
of Conviction and Sentence dated 22.06.2010 passed in
C.C.No.234 of 2009 by the learned XX Additional Chief
Metropolitan Magistrate, Hyderabad for the offence under Section
138 of the Negotiable Instruments Act, was confirmed.
02. Learned counsel for revision petitioner would submit
that the matter has been compromised between the parties.
03. Having gone through the record, I do not find any
infirmity in concurrent findings recorded by both the Court below.
While confirming the conviction, since the case is quasi-criminal
in nature, keeping in view the submission made by learned
counsel for revision petitioner, the sentence of imprisonment is
reduced to that of the period already undergone by revision
petitioner. However, the fine component shall remain unaltered.
04. Accordingly, this Criminal Revision Case is partly
allowed. There shall be no order as to costs.
As a sequel, pending miscellaneous applications, if any,
shall stand closed.
