JUDGMENT :

(per Hon'ble Sri Justice P.SAM KOSHY)

When the matter is taken up to-day for hearing, Mr.K. Krishna

Kalyan, learned counsel appearing on behalf of Mr. K. Venumadhav,

counsel for the appellant / accused No.1, fairly submitted that the

appellant herein has filed another Criminal Appeal, viz., Criminal

No.1234 of 2016 through the High Court Legal Services Authority

wherein a counsel has been appointed under Legal-Aid to contest the

matter, and that the same is pending before this Court. He further

submitted that the appellant has also obtained bail vide order dated

08.12.2022 in I.A.No.1 of 2022 in Criminal Appeal No.1234 of 2016

passed a learned Division Bench of this Court. He therefore submitted

in view of above development, he does not wish to pursue the present

appeal and prayed that the present appeal may be closed as 'not

pressed'.

2. In view of above submissions and also taking note of the fact

that the appellant has already filed another appeal before this Court,

viz., Criminal No.1234 of 2016, through the High Court Legal Services ::2::

Authority and also obtained bail in the said appeal, we are of the

considered view that the present appeal may be disposed of as 'not

pressed' reserving the right of the appellant / accused No.1 to pursue

Criminal Appeal No.1234 of 2016.

3. Accordingly, the Appeal stands disposed of as 'not pressed'. No

costs.
