                WRIT PETITION No.5754 of 2024
ORDER:

This Writ Petition, under Article 226 of the Constitution

of India, is filed seeking the following relief:

"..to issue writ, order or direction more particularly one in the nature of writ of mandamus directing the respondents to consider bids submitted by the Petitioner in respect of 1) Tender Notice No 179-CR-SC-23-0T, 2) Tender Notice No. 180-N-SC-23OT, 3) Tender Notice No. 181-N-SC-23-OT, 4) Tender Notice No. 182-N- SC-23-OT, 5) Tender Notice No. 183-S-SC-23OT, 6) Tender Notice No. 184-W-SC-23-OT with closing date 08.01.2024 issued by 6th Respondent on merits and as per the judgment dated 07.02.2024 made in W.P.No.2995 of 2024 by this Hon'ble High Court whereunder the banning of business proceedings No 2020/CE-1/ CBL/3/SCR Nirman against the petitioner, dated 12.01.2024 was set aside and consequently declaring the action of the respondents in not considering bids of the petitioner on the ground that the petitioner was banned by Railway Board, as illegal, arbitrary, unjust and violation of principles of natural justice and contrary to the letter and spirit of the judgment of this Court.."

2. Heard Sri L.Preetham Reddy, learned counsel for

the petitioner, Smt N.V.R.Rajya Lakshmi, learned counsel

representing Sri Gadi Praveen Kumar, learned Deputy

Solicitor General of India, appearing for respondent Nos.1, 3

to 7 and Sri K.Mohan, learned Standing Counsel appearing

for respondent No.2.

3. When the matter is taken up for hearing,

Sri K.Mohan, learned Standing Counsel for respondent No.2-

Railway Board fairly submits that in terms of the order

passed by this Court in W.P.No.2995 of 2024, dated

07.02.2024, the tenders relating to petitioner-company were

reconsidered and issued order vide proceedings No.2020/CE-

I/CBL/3/SCR Nirman, dated 09.05.2024.

4. Since respondent No.2 has examined the case of

the petitioner in terms of the order passed by this Court in

W.P.No.2995 of 2024, dated 07.02.2024, no further orders are

required to be passed in this writ petition.

5. Recording the submission made by learned

Standing Counsel for respondent No.2, the Writ Petition is

closed as no further orders are necessary. There shall be no

order as to costs.

Miscellaneous petitions, if any, pending in this Writ

Petition shall stand closed.
