                  M.A.C.M.A No.1710 OF 2011

JUDGMENT:

1. The appellant-claimant filed this appeal against the Order

and Decree dated 04.01.2007 in M.V.O.P.No.708 of 2004 on the

file of the Motor Accident Claims Tribunal-Cum-District Judge,

Karimnagar, where under the Tribunal granted an amount of

Rs.2,11,558/- towards compensation along with interest @ 7.5%

per annum as against the claim of Rs.5,00,000/- on account of

the injuries received in the motor vehicle accident occurred on

24.01.2002.

2. Heard the learned counsel for the appellant and the learned

counsel appearing for respondent No.3-Insurance Company.

3. On 24.01.2002, while the claimant was proceeding on his

motorcycle along with his friend, a van at a high speed in the

opposite direction came in a rash and negligent manner and

dashed the motorcycle, due to which the claimant and his friend

fell down and received injuries all over the body.

4. The only ground raised by the learned counsel for the

claimant is that the Tribunal had considered only Rs.45,000/-

towards grievous injuries.

5. All the aspects regarding injuries received, treatment taken

and the liability are all not disputed. Keeping in view the

sufferance of the claimant, this Court deems it appropriate to

award Rs.25,000/-towards each grievous injury which comes to

Rs.75,000/- in total.

6. In the result, the Motor Accident Civil Miscellaneous Appeal

is partly allowed enhancing the compensation awarded by the

Tribunal from Rs.2,11,558/- to Rs.2,41,558/-. The enhanced

amount shall carry interest @ 7.5% per annum from the date of

petition till the date of realization. Except the above enhancement,

the award of the Tribunal shall remain same on all other aspects.

Miscellaneous applications, if any pending, shall stand closed.
