                WRIT PETITION No.31586 of 2012
ORDER:

(per the Hon'ble the Chief Justice Alok Aradhe)

Mr. Deepak Bhattacharjee, learned Senior Counsel

appears for the petitioner.

Ms. D. Madhavi, learned Standing Counsel for

Hyderabad Metropolitan Development Authority appears for

respondent No.2.

2. In this Writ Petition, the petitioner has prayed for the

following relief:

"......in the nature of writ of mandamus declaring the order of Respondent No.2 in issuing the letter with Reference No.6711/MP2/Plg/H/2005 dated 24.09.2012 directing the petitioner to submit the NOC from the Revenue Divisional Officer, Chevella Division, Ranga Reddy District, for non agricultural purpose as per the Andhra Pradesh Agricultural Land (Conversion for non-agricultural purpose) Act and Rules 2006 is arbitrary, illegal, violative of the fundamental rights under Article 14 and 19(1)(g) of the Constitution of India, violative of Constitutional Guarantee under Article 300-A of the Constitution of India, hit by doctrine of promissory estoppels and quash the same."

3. Learned counsel for the parties jointly submit that the

issue involved in this Writ Petition is squarely covered by the 2 CJ & JSR, J

common judgment dated 28.08.2015 passed in Writ Appeal

No.702 of 2010 and batch.

4. It is also pertinent to mention that in pursuance of an

interim order dated 09.10.2012 passed by the learned Single

Judge of erstwhile High Court of Andhra Pradesh, the layout

has already been approved.

5. Therefore, no further orders are required to be passed in

the Writ Petition.

6. Accordingly, the Writ Petition is disposed of.

Miscellaneous applications, if any pending, shall stand

closed. There shall be no order as to costs.
