CIVIL REVISION PETITION No.2896 of 2023
ORDER:
The Civil Revision Petition has been filed seeking the
following relief:
"...to set-aside the impugned order dated 19.09.2017 in E.P. No. 07 of 2006 in O.S. No. 362 of 2003 passed by the XIII Addl. Senior Civil Judge (FTC) City Civil Courts, Secunderabad including the execution of the registered sale deed vide Doc.No.1554/2007 dated 23.08.2007 before Sub- Registrar Secunderabad in favour of Respondents/Decree Holders and consequently restore the possession of the E.P. scheduled property to the Petitioner/Judgment Debtor..."
2. Heard Sri Venkat Rao Patil, learned counsel for the
petitioner.
3. Considering the fact that the impugned order is one
which has been passed on 19.09.2017 and the instant Civil
Revision Petition has been filed only on 05.09.2023 i.e. after
a period of more than six (6) years, this Court does not find
any strong case made out by the learned counsel for the
petitioner calling for an interference to the same after so
long a period.
4. The Civil Revision Petition definitely suffers from delay
latches and therefore stands dismissed only on the ground
of delay latches. Nonetheless, the petitioner would not be
precluded from availing of such other remedies available to
him under the law. No costs.
As a sequel, miscellaneous petitions, if any pending,
shall stand closed.
