                      SECOND APPEAL No.713 of 2010

JUDGMENT:

This Second Appeal is filed by the appellant-appellant-defendant

aggrieved by the judgment and decree dated 11.03.2010 passed in A.S.No.164 of

2005 on the file of the I Additional Chief Judge, City Civil Court, Secunderabad,

confirming the judgment and decree dated 18.01.2005 passed in O.S.No.105 of

1999 on the file of the XII Additional Senior Civil Judge (Fast Track Court), City

Civil Court, Secunderabad.

2. When the matter came up for hearing on 30.08.2023, there is no

representation by the learned counsel for the appellant as well as learned counsel

for the respondents. The matter was posted to 26.09.2023 under the caption 'for

dismissal'. Even today also, there is no representation by the learned counsel for

the appellant though the matter is posted under the caption 'for dismissal'. It

appears that the appellant is not evincing any interest in proceeding with the

matter.

3. In the result, the Second Appeal is dismissed for default. No costs.

Miscellaneous petitions, if any pending shall stand closed.
