       WRIT APPEAL Nos.625, 626, 627 & 706 OF 2009

COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Alok Aradhe)

       Ms. D. Madhavi, learned Standing Counsel for HMDA for

the appellants in all the writ appeals.

       Mr. N. Praveen Reddy, learned counsel, representing

Mr. N.Vasudeva Reddy, learned counsel for the respondent Nos.1

to 6 in W.A.No.625 of 2009.

2. These intra court appeals have been filed against the orders

dated 28.01.2009 in W.P.No.17406 of 2007, dated 11.02.2009 in

W.P.No.13004 of 2007, dated 11.02.2009 in W.P.No.17295 of

2007 and order dated 04.03.2009 in W.P.No.17933 of 2007, by

which the writ petitions preferred by the respondents/writ

petitioners have been allowed.

3. Learned counsel for the parties jointly submitted that the

controversy involved in these intra court appeals is squarely

covered by a Division Bench judgment of this Court dated ::2::

26.04.2006 in W.A.No.888 of 2009. The said judgment reads as

under:

"Learned counsel for the parties stated that the challenge raised in the instant writ appeal and in Writ Appeal Nos.351, 353 and 354 of 2009 is same. These three appeals have already been disposed of by this Court vide order dated 16.02.2016. The order reads thus:

"Mr. B.Mahender Reddy, learned Special Government Pleader has filed affidavit dated 16.03.2016 of K.Swarnalatha, Land Acquisition officer, HMDA, Tarnaka, Hyderabad, stating that the lands involved in these appeals are not required at this juncture. She has given all the details in the affidavit. The affidavit is taken on record.

In view of the affidavit filed by K.Swarnalatha, Mr.B.Mahender Reddy, learned Special Government Pleader does not press the appeals.

The writ appeals are disposed of as not pressed. Consequently, pending miscellaneous applications shall remained closed. No costs."

Learned counsel for the parties state that this appeal may also be disposed of in terms of the foresaid order.

Writ appeal is accordingly disposed of in terms of the said order".

4. In view of the aforesaid submissions made by learned

counsel for the parties and for the reasons assigned by the Division

Bench in W.A.No.888 of 2009, these appeals are disposed of in

terms of the order passed by the Division Bench in W.A.No.888 of

2009. There shall be no order as to costs.

As a sequel, miscellaneous petitions, pending if any, stand

closed.
