       THE HONOURABLE SRI JUSTICE K.SARATH

                   C.C.C.A.No.312 of 2003

JUDGMENT:

When the matter came up for hearing on 04.08.2023

there was no representation for the appellant, therefore the

matter was directed to be listed on 28.08.2023 under the

caption 'for dismissal" and on 29.08.2023, at request of

learned counsel for the appellant, the matter was directed

to be listed on 20.09.2023. In spite of it, today also there

is no representation for the appellant. Therefore, this Court

has no option except to dismiss the appeal for non-

prosecution/default.

2. Accordingly, the Appeal is dismissed for non-

prosecution/default. No order as to costs.

3. Pending miscellaneous applications, if any, shall

stand dismissed.
