                     SECOND APPEAL No.659 of 2010

JUDGMENT:

This Second Appeal is filed by the appellants - defendants aggrieved by

the judgment dated 06.03.2010 passed in A.S.No.3 of 2009 by the District

Judge, Khammam reversing the judgment and decree dated 29.09.2008 passed

in O.S.No.81 of 2004 by the Senior Civil Judge, Khammam.

2. When the matter came up for hearing on 29.08.2023, there was no

representation by the learned counsel for the appellants. Accordingly, the

matter was directed to be posted to 18.09.2023 under the caption 'for

dismissal'. Even today also, there is no representation by the learned counsel

for the appellants though the matter is posted under the caption 'for dismissal'.

It appears that the appellants are not interested in prosecuting the matter.

3. As the appellants are not evincing any interest in proceeding with the

matter, it is considered fit to dismiss the appeal.

4. Hence, the Second Appeal is dismissed for default. No order as to

costs.

As a sequel, miscellaneous applications pending in this appeal if any,

shall stand closed.
