SECOND APPEAL NO. 457 OF 2005
JUDGMENT:
Plaintiff has filed O.S. No.1446 of 1999 on the file of
XVIII Junior Civil Judge-cum-Additional Rent Controller,
Secunderabad, for declaration and to direct the defendant
to vacate and deliver the vacant possession of the plaint
schedule premises and for mesne profits. The trial Court
decreed the suit. The unsuccessful defendant preferred
appeal vide A.S. No.47 of 2003 wherein the appellate Court
confirmed the judgement and decree of the trial Court,
against which the second appeal has been filed.
2. A perusal of the docket proceedings shows that the
learned counsel for the appellant did not evince any
interest to pursue the second appeal proceedings. On
11.08.2023 there was no representation on behalf of the
learned counsel for the appellant, in spite of posting the
matter under the caption 'for dismissal' he has not turned
up today. No purpose would be served in continuing the
Second Appeal.
3. Accordingly, the Second Appeal is dismissed for non-
prosecution. No order as to costs.
Pending miscellaneous applications, if any, shall
stand closed.
