                APPEAL SUIT NO.3447 OF 2000

JUDGMENT:

1. On 06.09.2023 there is no representation from the appellant

and the matter is listed to today under the dismissal caption.

Inspite of the appeal is listed under the dismissal caption, learned

counsel representing learned counsel for appellant seeks time to

argue the matter stating that the senior counsel is out of station.

The proceeding sheet shows that multiple adjournments are

granted earlier and the same request is renewed. I do not find

any valid reason to adjourn the matter.

2. The appeal pertains to the year 2000 and the appellant is

not evincing any interest in prosecuting the case.

3. Accordingly, the Appeal Suit is dismissed for non-

prosecution. No costs. Miscellaneous petitions, pending if any,

shall stand closed.
