JUDGMENT:

This appeal is filed by the appellant aggrieved by the judgment and

decree passed in A.S.No.17 of 2007 dated 16.11.2009 by the II Additional

District Judge, Nalgonda at Suryapet confirming the judgment and decree

passed in O.S.No.9 of 2005 dated 08.03.2007 by the Senior Civil Judge,

Suryapet.

2. When the matter came up for hearing on 11.08.2023, there was no

representation by the learned counsel for the appellant. Accordingly, the matter

was directed to be posted to 04.09.2023 under the caption 'for dismissal'. Even

today also, there is no representation by the learned counsel for the appellant

though the matter is posted under the caption 'for dismissal'. It appears that the

appellant is not interested in prosecuting the matter.

3. As the appellant is not evincing any interest in proceeding with the

matter, it is considered fit to dismiss the appeal.

4. Accordingly, the Second Appeal is dismissed for default.

No order as to costs.

As a sequel, miscellaneous applications pending in this appeal, if any,

shall stand closed.
