                       APPEAL SUIT No.165 of 2019


JUDGMENT:

This appeal is filed by the appellants - defendants aggrieved by the

judgment and decree passed in O.S.No.116 of 2014 dated 10.04.2018 in

decreeing the suit filed by the plaintiff, by the Senior Civil Judge,

Mahabubnagar District at Shadnagar.

2. When the matter was taken up hearing on 23.08.2023, there was no

representation by the learned counsel for the appellants. The learned counsel

for the respondent present and reported that the matter was settled. As such, the

matter was directed to be posted under the caption "dismissal" on 04.09.2023.

Even today, there is no representation by the learned counsel for the appellants

though the matter is posted under the caption "dismissal"

3. Hence, considering that there is no representation for the appellants and

the submission of the learned counsel for the respondent that the matter was

settled, it is considered fit to dismiss the appeal.

4. Accordingly, the Appeal Suit is dismissed.

No order as to costs.

As a sequel, miscellaneous applications pending in this appeal if any,

shall stand closed.
